Definitions

“We” “us” or “our” means Adventures in Preservation.
“You” or “your” means the client.

Insurance

1. Joining one of our adventures overseas or in the U.S. carries with it a small risk of injury or illness, and you must be protected by adequate travel insurance for the duration of your trip. We are happy to offer advice on suitable policies on request, but it is your responsibility to ensure that you are appropriately covered by purchasing a travel insurance policy. Your travel insurance policy should cover:

Emergency medical care and repatriation if necessary;

Claims, including those for emergency medical treatment, arising from the time you depart for your trip and continuing through the dates of the Adventures in Preservation project session.


Visas

1. We can assist you in finding the necessary information on obtaining relevant visas for your adventures, but the issuing of these is at the discretion of the relevant authority and is beyond our control. Requirements may change without notice or a visa may be refused. This is beyond the control and not the responsibility of Adventures in Preservation.

2. You are responsible for ensuring that your passport, visa and any other travel documents are valid for the duration of your trip.

3. Tourists visas are applicable for our volunteer vacations.


Registration, Payment and Cancellations by the Client

1. A completed registration form and a 50% deposit are required to reserve your place in a project session.

2. Your 50% deposit is non-refundable. If you cancel prior to 45 days before the start of the AiP session for which you registered, your deposit may be transferred to another session.

3. Final payment is due in-full no later than 45 days prior to the start of the project.

4. A significant part of the fee paid by you will be spent or committed to budgets prior to the start date of your project session, and we are therefore unable to offer a full refund if you choose to cancel. If you have paid in-full and notify AiP of cancellation prior to 45 days before the start of the project session, 50% of your payment will be refunded. The 50% deposit is non-refundable, but may be applied to another project. No reimbursement is possible if cancellation occurs after this date or during the project. We strongly recommend the purchase of trip cancellation insurance.

5. If space is still available at a project after the 45-day final payment deadline, registration is accepted with full payment.


Amendments and Cancellations by Adventures in Preservation

1. The nature of our projects is such that details of your session may differ slightly from those originally posted on our website and included in your Welcome Packet. We will do our very best to minimize such changes and to inform you promptly if changes do arise.

2. In very occasional circumstances, we may need to cancel a project session. In such cases, we will inform you not less than 45 days before your session start date and refund all fees you have paid to us. This will be the full extent of our liability and we will not accept responsibility for other costs you may incur, such as flight ticket penalties.

3. If cancellation occurs due to circumstances beyond our control, including security threats, terrorist activity, political instability or natural disasters, we will refund all fees you have paid to us. This will be the full extent of our liability and we will not accept responsibility for other costs you may incur, such as flight ticket penalties.


Accommodation & Food

1. Your accommodation and most meals will be covered by your fee during your project session dates. Meals not covered are detailed on the project description page on the Adventures in Preservation website.


Complaints

1. We are here to help you, and our staff will do their very best to provide the highest level of service. However, a formal procedure for complaints is set out below.

2. We are providing you with an opportunity to experience local culture, learn skills and gain on-site work experience at a historic site. If you have any problem that you find difficult to deal with, or which you feel is our responsibility to resolve, please follow this procedure: Talk to the Adventures in Preservation representative on site, or the staff member who assisted you in registering for your project session. This is the person, or persons, with the greatest understanding of your situation, and he or she will do their best to help you. If you are unhappy with the response, please put it in writing to our US office either by email or post as soon as possible. In the event of a claim for compensation, details of the claim must be received by us in writing no more than 30 days after the end date of your project session.

3. The above procedure exists to enable us to identify and deal with problems and complaints as quickly and efficiently as possible. Failure to follow this procedure may compromise our ability to help you. We will not be responsible for problems or complaints not brought to our attention as above.

4. In any action or arbitration brought by you against Adventures in Preservation, regardless of the legal theory on which the claim is founded, damages against Adventures in Preservation are limited to the price paid by you to Adventures in Preservation to attend the project session.

5. Proper Law and Jurisdiction – Your project waiver agreement, and any claims arising in connection with your Adventures in Preservation project session, are governed by the laws of the State of Colorado and the United States of America. Any disputes arising under this agreement or any claims arising in connection with the Adventures in Preservation project shall be subject to binding arbitration in Denver, Colorado. Venue for such arbitration shall be limited to Denver, Colorado.


Your Responsibility

1. We reserve the right to take appropriate action in the event of behavior which would reasonably be expected to give offence to hosts, project managers, work colleagues or others.

2. Please note that your booking is accepted with the understanding that you are attending the project session at your own risk. You agree to release Adventures in Preservation, our officers, directors, staff, employees, technical experts and anyone else directly or indirectly connected to the project from any liability in the event of any injury or damage of any nature (including death) to you or anyone else caused by your enrollment in the project session.

It is not possible for us to be responsible for the actions or omissions of those over whom we have no direct control, such as employees of airlines, local transport and others. Equally we are not responsible for loss or expense due to war, riots, strikes, terrorist activities, natural disasters, or bankruptcies

3. Please note that we reserve the right to decline to accept any person onto a placement, or to require any participant to withdraw at any time, when such action is determined by the appropriate Adventures in Preservation staff representative to be in the best interests of the health, safety, and general welfare of the project or of the individual participant. In such a case, we accept no responsibility for any airline cancellation penalty incurred by the purchase of a non-refundable ticket or any other cost that you may incur.


WAIVER

By completing the registration process, you agree to the following waiver and release of liability.

I AGREE to allow Adventures in Preservation to use any and all images or testimonials taken of or provided by me during the trip in any or all materials produced for organizational promotional or publicity purposes, without right of review.

I ACCEPT THE FOLLOWING:
• The Participant assumes all risks of participating in the Adventures in Preservation workshop.

• The Participant releases Adventures in Preservation, their officers, directors, employees, technical experts, and anyone else directly or indirectly connected to the workshop, from any liability in the event of any injury or damage of any nature (including death) to the Participant or anyone else caused by the Participant's enrollment in the workshop.

• In any action or arbitration brought by the Participant against AiP, regardless of the legal theory upon which the claim is founded, damages against AiP shall be limited to the price paid by the Participant to Adventures in Preservation to participate in the workshop. AiP is not liable for circumstances resulting from the cancellation, for any reason, of the workshop and will not be liable for any other damages whether or not such damages were foreseeable.

• This release shall be binding upon the Participant, the Participant's heirs, personal representatives and legal representatives, and anyone who could claim an interest through the Participant.

• This agreement, and any claims arising in connection with the workshop, shall be governed by the laws of the State of Colorado and the United States of America. Any disputes arising under this agreement or any claims arising in connection with the workshop shall be subject to binding arbitration in Denver, Colorado. Venue for such arbitration shall be limited to Denver, Colorado.
